I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by sections 53 and 78 of the Health Act 2004 (No. 42 of 2004) (as adapted by the Health and Children (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 219 of 2011 )), hereby make the following regulations:

1. (1) These Regulations may be cited as the Health Act 2004 (Complaints) (Amendment) Regulations 2018.

(2) The Principal Regulations and these Regulations may be cited together as the Health Act 2004 (Complaints) Regulations 2006 and 2018 and shall be construed together as one.

2. In these Regulations “Principal Regulations” means the Health Act 2004 (Complaints) Regulations 2006 ( S.I. No. 652 of 2006 ).

3. The Principal Regulations are amended by inserting after Regulation 20 the following regulation:

“21. Without prejudice to the functions of the Executive provided for in Regulation 20, the Minister may arrange for a person or body, other than the Executive, service providers and bodies to whom or persons to which the Executive has assigned its functions under section 49(4), to provide services to support persons making or seeking to make a complaint, subject to the agreement of such persons, including making complaints on behalf of such persons pursuant to section 46(3).”

EXPLANATORY NOTE

These Regulations amend the Health Act 2004 (Complaints) Regulations 2006 by inserting Regulation 21 to allow the Minister to arrange for a person or body other than the Executive, service providers and bodies to whom or persons to which the Executive has assigned its functions under section 49(4) to provide services to support the person making or seeking to make a complaint, subject to the agreement of such persons.
