PHARMACY ACT 2007 (COMMENCEMENT) ORDER 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 2nd December, 2008.

I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by section 1(2) of the Pharmacy Act 2007 (No. 20 of 2007), hereby order as follows:

1. This Order may be cited as the Pharmacy Act 2007 (Commencement) Order 2008.

2. In this Order “Act” means the Pharmacy Act 2007 (No. 20 of 2007).

3. The 29th day of November 2008 is appointed as the day on which the following provisions of the Act come into operation:

(a) sections 4, 13 (other than subsections (1)(a)(iv) and (1)(c)), 14 to 17, 19, 21 to 24 and 59 to 62;

(b) Part 5 (other than sections 27(e), 28(d) and 29(e));

(c) Part 7;

(d) Part 8 (except insofar as it is already in operation);

(e) Schedules 2, 3 and 4.

4. The 1st day of January 2009 is appointed as the day on which sections 13(1)(a)(iv), 13(1)(c) and 20 of the Act come into operation.

5. The 1st day of April 2009 is appointed as the day on which sections 27(e), 28(d) and 29(e) of the Act come into operation.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be legal interpretation).

This Commencement Order brings into operation provisions of the Pharmacy Act 2007 as they concern the Pharmaceutical registration system, offences, powers of investigation and related issues in the Schedules to the Act. The Commencement Order also repeals the pharmacy related enactments as specified in Schedule 4.
