MENTAL HEALTH ACT 2001 (PERIOD PRESCRIBED UNDER SECTION 72(6)) REGULATIONS 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 29th February, 2008.

I, JIMMY DEVINS, Minister of State at the Department of Health and Children, in exercise of the powers conferred on me by section 5(1) and section 72(6) of the Mental Health Act 2001 , (No. 25 of 2001) and the Health and Children (Delegation of Ministerial Functions) (No.4) Order 2007 ( S.I. No. 717 of 2007 ), hereby make the following regulations:

1. These regulations may be cited as the Mental Health Act 2001 (Period Prescribed under Section 72(6)) Regulations 2008.

2. The period of one year and four months from the commencement of Part 2 is prescribed for the purposes of section 72(6) of the Mental Health Act 2001 (No. 25 of 2001).

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

This instrument shortens the period prescribed in Section 72(6) of the Mental Health Act 2001 . The period prescribed from the commencement date of Part 2 of the Mental Health Act 2001 (1 November 2006) is now 1 year and 4 months (1 March 2008).

This instrument may be cited as the Mental Health Act 2001 (Period Prescribed under Section 72(6)) Regulations 2008.
