STATUTORY RULES AND ORDERS. 1934. No. 369.

BEEF SUPPLY (APPOINTED AREA No. 3) ORDER, 1934.

WHEREAS it is enacted by sub-section (1) of Section 45 of the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934), that whenever the Minister for Agriculture is satisfied in respect of any particular area that it is for any reason not practicable to make under Part IX, of the said Act a contract for such area with a registered proprietor of registered victualling premises for the free supply of beef to recipients, the Minister may with the consent of the Minister for Finance by order—

(a) declare such area to be an appointed area for the purposes of the said Act, and

(b) require the registered proprietor of every registered victualling premises in such area, on demand made in accordance with the said Act by a recipient, to supply free of charge to such recipient such quantity of beef of a specified kind and quality as shall be lawfully so demanded by such recipient, and

(c) fix the maximum weekly quantity of such beef which each such registered proprietor shall be obliged so to supply to recipients, and

(d) fix the price to be paid by the said Minister to each such registered proprietor for the beef so supplied by such registered proprietor:

AND WHEREAS the Minister for Agriculture is satisfied that in respect of the area to which this Order relates it is not practicable to make under Part IX of the said Act a contract for such area with a registered proprietor of registered victualling premises for the free supply of beef to recipients:

NOW, I, SEAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934), and of every and any other power me in this behalf enabling, do hereby order as follows, that is to say—

1. This Order may be cited for all purposes as the Beef Supply (Appointed Area No. 3) Order, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order the expression " the Act " means the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934).

4. The counties (including all urban districts therein) and county boroughs mentioned in the First Schedule to this Order shall be and are hereby declared to be an appointed area for the purposes of the Act.

5. The registered proprietor of every registered victualling premises in the said appointed area shall, on demand made in accordance with the Act by a recipient, supply free of charge to such recipient such quantity (within the maximum applicable to such registered proprietor under this Order) of beef of the kind and quality prescribed by this Order as shall be lawfully so demanded by such recipient.

6. The kind and quality of beef to be supplied by the registered proprietor of registered victualling premises to a recipient in pursuance of this Order shall be beef (other than shin or leg beef from which the bone has not been removed and other than neck beef) obtained from a first quality bullock or maiden heifer aged not more than four years.

7. The maximum weekly quantity of such beef as aforesaid to be supplied by any particular registered proprietor of registered victualling premises to recipients in pursuance of this Order shall be the quantity stated in the fourth column of the Second Schedule hereto opposite the name of such registered proprietor where it is mentioned in the second column of the said Schedule.

8. The price to be paid by the Minister for Agriculture in pursuance of the Act to registered proprietors of registered victualling premises for beef supplied by them to recipients in pursuance of this Order shall be at the rate of five pence the pound.
