Behan v Grove Turkeys Ltd

Claimant had received written and oral warnings on disciplinary related matters. He requested for an annual day's leave on 29 December 1998 and was declined. He took it anyway and on returning to work the following day he was summoned for a disciplinart hearing in which he was re[presented by a shop steward. Following this he was informed by letter that he was dismissed and informed of the appeal procedures open to him. Claimant did not avail of the appeal procedure. Tribunal determined that he had been fairly dismissed but he was entitled to compensation for notice and awarded £1,560.
