"Family" - Increase of Rent and Mortgage Interest (Restrictions) Act, 1923 (No. 19 of 1923), s. 1 (h) -Tenant - Woman dying intestate - "Member of the tenant's family" - Residence with tenant at time of her death.
The niece of a tenant of controlled premises having left her family home and gone to stay with the tenant for some months prior to, and until, the death of the latter intestate, in order to act as her companion and nurse, but without showing any intention of permanently residing with her. Held, that she was not a member of the tenant's family, nor residing with the tenant at the time of the tenant's death, within the meaning of s. 1 (h) of the Increase of Rent and Mortgage Interest...
