Negligence of soldier on duty - Action not maintainable -Constitution of the Irish Free State (Saorstát Eireann) Act, 1922 (No. 1 of 1922), Sch. I., Arts. 2. 46, 51, 54, and 56 - Defence Forces (Temporary Provisions) Act, 1923 (No. 30 of1923), ss. 148 and 160 - Ministers and Secretaries Act, 1924 (No. 16 of 1924), ss. 1 and 2 - Defence Forces (Enlistment) Regulations, 1926.

The Minister for Defence, who is the head of the "Department of Defence," created by s. 1 (x) of the Ministers and Secretaries Act, 1924 (No. 16 of 1924), is not liable for the negligent act of a soldier on duty. Per Sullivan, P.: The members of the armed forces of the State are servants of the public in the employment of the Government, and, as such, fellow-servants of the Minister for Defence, and for their neglect or default he would not primâ facie be liable. The Legislature did not intend, by s. 2 of the Ministers and Secretaries Act, 1924, to impose upon each of the Ministers mentioned in s. 1 of the Act a liability for the wrongful acts or defaults of the persons employed in his Department.
