Procedure:

In accordance with Section 41 of the Workplace Relations Act, and following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complainant was employed from 15th July 2016 until the employment terminated on 3rd May 2017. The Complainant was paid €12.00 an hour and he worked 40 hours a week. The Complainant referred a complaint to the Workplace Relations Commission on 7th September 2017 alleging the Respondent had breached Section 5 of the Payment of Wages Act. He is claiming payment of €684.00 in wages – annual leave on termination of the employment of €140.16. These amounts were due to be paid to him on 3rd May 2017.
