Procedure:

This complaint was submitted to the WRC on February 19^th 2019 and, in accordance with Section 79 of the Employment Equality Acts 1998 - 2015, it was assignedto me by the Director General. A hearing was arranged for October 2^nd 2019 at 12.30pm for the parties to have an opportunity to be heard and to present evidence relevant to the complaint. Ms Waters did not attend the hearing.

Decision:

Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.

In accordance with Section 79 of the Employment Equality Act, I am obliged to hold a hearing. I am satisfied that Ms Waters was notified of the arrangements for the hearing on October 2nd 2019 and I find that her failure to attend was unreasonable.
