Procedure:

In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.

Background:

The Worker was employed by the Employer as a general operative from August 30th, 2021, until December 20th, 2021. The Worker referred a dispute under the Industrial Relations Acts (as amended), for investigation. No objection was received from the Employer within the time-frame prescribed, in the legislation.

Summary of Worker’s Case:

The Worker did not attend and was not represented.

Summary of Employer’s Case:

The Employer attended and was represented.

Conclusions:

The dispute was received by the Director General of the Workplace Relations Commission on 21st March 2022.

The said dispute was referred to me for investigation. A hearing for that purpose was arranged for 23rd August 2022. Having been notified of the date, time and venue for the hearing, there was no appearance by or on behalf of the worker or reason proffered for his non-attendance to present his case at the hearing convened for that purpose.

Recommendation:

Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
