CIRCUIT COURT (FEES) ORDER, 1983.

I, MICHAEL NOONAN, Minister for Justice, in exercise of the powers conferred on me by section 65 of the Courts of Justice Act, 1936 (No. 48 of 1936), and with the consent of the Minister for Finance, hereby order as follows: 1. This Order may be cited as the Circuit Court (Fees) Order, 1983. 2. This Order shall come into operation on the 1st day of August, 1983. 3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 4. In this Order "the Principal Order" means the Circuit Court (Fees) Order, 1982 ( S.I. No. 44 of 1982 ). 5. The Principal Order is hereby amended by the deletion of article 7. 6. The Schedule to the Principal Order is hereby amended by the Substitution of the following for Item 1 of Part II:

"1. On the issue of any ordinary civil bill, matrimonial civil bill or summons (including Interpleader, Ejectment, Replevin, civil bills in relation to the grant or revocation of Probate or Letters of Administration and Criminal Injury Applications), irrespective of the amount involved £10.00 The original civil bill or summons.

". 7. The Schedule to the Principal Order is hereby amended by the insertion after Part X of the following Part:

Proceedings under the following:

Illegitimate Children (Affiliation Orders) Act, 1930 (No. 17 of 1930)

Married Womens Status Act, 1957 (No. 5 of 1957)

Guardianship of Infants Act, 1964 (No. 7 of 1964)

Family Law (Maintenance of Spouses and Children) Act, 1976 (No. 11 of 1976)

Family Home Protection Act, 1976 (No. 27 of 1976)

Family Law (Protection of Spouses and Children) Act, 1981 (No. 21 of 1981)

Family Law Act, 1981 (No. 22 of 1981)

Item Fee Document to be stamped 1. On the issue or entry of every originating application £10.00 The application. 2. On the filing of an answer £2.00 The form of answer. 3. On every Order £5.00 The Order.
