Clarke v Glenbrook Engineering Ltd

Claimant had good working relationship with respondent. Respondent company encountered staff shortages and cash-flow problems causing difficulties for the claimant who was foreman. This resulted in the claimant tendering his resignion but agreeing to remain on for six weeks. Dispute in evidence as to the circumstances to staying on for the six weeks. Claimant then involved in car accident and was out of work. He believed his job was being kept for him but on his return it had been filled. The issue was whether he had resigned when he gave in his notice. The Tribunal determined that the claimant had been dismissed but that both parties were at fault in not clarifying the position of the six weeks. Loss was awarded on a...
