LEGALLY BINDING DECISION OF THE FINANCIAL SERVICES AND PENSIONS OMBUDSMAN
The Complaint concerns a credit card account with account number ending in 4251.
The Complainant’s Case
The Complainant contends that the Provider mal-administered his credit card payments in
2015 and 2016 and that, instead of paying off his outstanding credit card balance, his
cheque payments were incorrectly applied to third-party accounts.
The Complainant wrote to the Provider by letter dated 9 October 2018 stating that he had
made multiple credit card payments between 15 July 2015 and 20 June 2016 to his
account ending 4251. He stated that this left a balance of €50.43 (fifty euro and forty-three
cent) on the account at the time. He stated that as more payments may have been made
since 20 June 2016, he may have overpaid the account and that he may be entitled to a
reimbursement in that instance. The Complainant stated that the Provider may have
incorrectly deposited his funds to third party accounts.
By letter dated 29 October 2018, the Complainant submitted to the Provider as follows:
“my payments were always made on your slips, enclosed, how did they get into
other people’s accounts? If your bank had issued monthly statements as it was
