DATA PROTECTION (FEES) REGULATIONS, 1988.

I, GERARD COLLINS, Minister for Justice, in exercise of the powers conferred on me by sections 4 , 16 and 17 of the Data protection Act, 1988 (No. 25 of 1988), hereby, with the consent of the Minister for Finance, make the following regulations:

1. These Regulations may be cited as the Data protection (Fees) Regulations, 1988.

2. In these Regulations "the Act" means the Data Protection Act, 1988 (No. 25 of 1988).

3. An amount of £5 is hereby prescribed for the purposes of section 4(1) (c) (i) of the Act.

4. A fee of £2 is hereby prescribed for the purposes of section 16 (3) (b) of the Act.

5. A fee of £100 is hereby prescribed for the purposes of section 17 (2) of the Act in respect of an application for registration.

6. (1) A fee of £100 is hereby prescribed for the purposes of section 17(7) of the Act in respect of an application for continuance of registration.

(2) A fee of £50 is hereby prescribed for the purposes of section 17(7) of the Act in respect of an application for alteration of the particulars in an entry in the register.

EXPLANATORY NOTE.

These regulations prescribe the various fees payable under the Data protection Act 1988 : £5 (maximum) for obtaining access to data kept in relation to an individual; £2 for obtaining a certified copy of particulars in an entry in the register maintained under the Act; £100 for each registration of a person who is required to register or for continuing a registration; and £50 for altering particulars in an entry in the register.
