Grace v. O'Connor Unreported.
, 1891 (54 & 55 Vict. c. 57) — Lands taken as adjunct to demesne — Holding not agricultural or pastoral.
VoL. XXXII.] Q B. & EL DIVISIONS. 179 cannot be supplemented and rendered sufficient by adding or, as Appeal. has been said, " clubbing " the additional value conferred by or 1892. derived from the premises jointly occupied. I quite concur with HAY'S CASE, ETC. Lord Justice Fitz Gibbon that this construction renders the legis- lation in the Acts of 1868 and 1878 not very logical, for it is not Barry, L.J. very easy to assign a reason why a man occupying separately lodging premises of the value of £9 10s., and occupying in conÂnexion therewith, under the same contract, jointly with another, premises of the value of another £9 10s., is not as worthy of the franchise as a man who separately occupies only premises of the value of £10. But I think such is the necessary construction of the language of the statutes. SIR PETER O'BRIEN, C. J. :- The judgment I have already read also determines the ease of Edmiston and Ormsby. As to Maxwell's case, the Lord Chief Baron and I agree that the alteration of the claim after its verifiÂcation is fatal. The decision of the Revising Barrister in the four cases will therefore be reversed, and the names of the four claimants struck out of the register. Solicitor for the appellant : J. E. O'Doherty. Solicitor for the respondents : G. Y. D. ELIZABETH CATHERINE ALLEN, AND OTHERS, Land Corn. LESSORS ; ELIZABETH MARY GROGAN, LESSEE (1). - 1892. Nov. 26. Redemption of Rent (Ireland) Act, 1891 (54 81- 55 Viet. c. 57)-Lands taken as adjunct to demesne-Holding not agricultural or pastoral. Lands taken for a long term of years, not to make profit by farming, but as an adjunct to a demesne, are not agricultural or pastoral in their character, so as to entitle the lessee thereof to redeem his rent under the Redemption of Rent (Ireland) Act, 1891. This was an application under the Redemption of Rent (Ireland) Act, 1891, by Elizabeth Mary Grogan, the assignee of the lessee's (1) Before BEWLEY, J., and LYNCH and WRENCH, Commissioners. Von.
