EUROPEAN COMMUNITIES (INTERNAL MARKET IN NATURAL GAS) (BGÉ) (AMENDMENT) REGULATIONS 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th July, 2008.

I, EAMON RYAN, Minister for Communications, Energy and Natural Resources, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2003/55/EC 1 of the European Parliament and of the Council of 26 June 2003, hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Internal Market in Natural Gas) (BGÉ) (Amendment) Regulations 2008.

(2) These Regulations come into operation on the 4th day of July 2008.

2. The European Communities (Internal Market in Natural Gas) (BGÉ) Regulations 2005 ( S.I. No. 760 of 2005 ) are amended by substituting the following for Regulation 10:

“Minister to fix date for implementing transfer plan.

10. As soon as practicable after a transfer plan submitted in accordance with Regulation 9 has been approved by the Minister, the Minister shall fix a transfer date for the plan to be implemented, notice of which date shall be published in the Iris Oifigiúil as soon as practicable thereafter.”.

EXPLANATORY NOTE

These Regulations amend Regulation 10 of the European Communities (Internal Market in Natural Gas (BGÉ) Regulations 2005 ( S.I. No. 760 of 2005 ), by providing that the Minister for Communications, Energy and Natural Resources may publish a notice in Iris Oifigiuil setting a transfer date for the Transfer Plan between BGÉ and Gaslink to be implemented.
