Statute of Limitations-Judgment more than twelve years old-No payment or acknowledgment-Bight to issue execution-16 % 17 Viet. c. 113, s. 20Â37 4.38 Vict. c. 57, s. 8. Execution cannot be issued on a judgment where for twelve years there has been neither payment on foot thereof nor acknowledgment. Sherwood v. Hannan (15 L. R. Ir. 334) reversed. APPEAL by the plaintiff from an order of the Queen's Bench Division of the 10th November, 1885, refusing leave to issue exeÂcution on a judgment dated 9th August, 1871. LORD ASHBOURNE, C. :-(7) This is an appeal from an order of the Queen's Bench Division refusing leave to issue execution on a judgment, which was more than twelve years old, on the ground that it was barred by the recent statute, 37 & 38 Vict. c. 57, sect. 8, which enacts that " no action, (1) Before LORD Asn-sounNE, C., and FITZ GIBBON and BARRY, L.JJ. Hannan, argued on the 13th January, was listed for judgment at the same time as the present case. See infra, p. 173, and 17 L. R.. Ir. p. 270. VOL. XVIII.] Q. B., C. P., & EX. DIVISIONS. 171 or suit, or other proceeding shall be brought to recover any sum of money secured by any mortgage, judgment or lien, or otherwise charged upon, or payable out of, any land or rent at law or in equity, or any legacy, but within twelve years next after a present right to receive the same shall have accrued." The plaintiff contends that this is an action on a judgment; that it is not governed by that statute, but by the 20th section of the Common Law Procedure Act...
