Abstract:

Unfair dismissal - Dismissal not in dispute - Misconduct - Procedure for investigating misconduct.

Claimant worked as a labourer. He arrived late for work one Saturday and left without informing anybody which, in the circumstances, put the public at risk. The respondent called the claimant to the office the following day and dimissed him. The Tribunal determined that the claimant had contributed substantially to his dismissal but that the respondent had failed to properly investigate the incident. Claimant awarded £585.
