FREEDOM OF INFORMATION ACT, 1997 (THIRD SCHEDULE) (AMENDMENT) REGULATIONS, 1998

I, Charlie McCreevy, Minister for Finance, in exercise of the powers conferred on me by section 3 of the Freedom of Information Act, 1997 (No. 13 of 1997), hereby make the following regulations with respect to which, pursuant to section 3(3) of that Act, a draft has been laid before each House of the Oireachtas and a resolution approving of the draft has been passed by each such House:

1. These Regulations may be cited as the Freedom of Information Act, 1997 (Third Schedule) (Amendment) Regulations, 1998.

2. The Third Schedule to the Freedom of Information Act, 1997 (No. 13 of 1997) is hereby amended -

(a) in Part I thereof, by the substitution -

(i) in the first column of "No.22 of 1994" for "No.21 of 1996", and

(ii) in the second column of "An Bord Bia Act, 1996" for " An Bord Bia Act, 1994 ", and

(b) in Part II thereof -

(i) by the insertion in the appropriate chronological place of

EXPLANATORY NOTE

These Regulations provide for the correction of a typographical error with regard to the number and year of an enactment listed in the Third Schedule to the Freedom of Information Act, 1997 (No. 13 of 1997). They also provide for addition of a reference to the Access to Information on the Environment Regulations, 1998, and of a reference to the Health Services Regulations, 1971, to that Schedule. This means that the Freedom of Information Act will override restrictions on access to information under those Regulations.
