Abstract:

Unfair dismissal - Misconduct - Timekeeping and absences

Claimant had a poor record in timekeeping and absences. He received warnings on this but resented correction and had an attitude problem. While a new basic rate was being negotiated the claimant refused to work. During a heated discussion in the office the claimant, it was alleged, spat at the respondent's wife. Following this incident and on account of the claimant's other problems, the respondent dismissed him. There was a conflict in the evidence. The Tribunal determined, on balance that the claimant was unfairly dismissed but that he had substantially contributed to it. In total thet awarded £363.
