1. Appeal of Adjudication Officer Decision No. ADJ-00007424.

2. The employee appealed the Decision of the Adjudication Officer to the Labour Court on the 26 June 2017. A Labour Court hearing took place on the 17 April 2018. The following is the Determination of the Court:

In accordance with section 41(1) of the Workplace Relations Act 2015 the Court convened a hearing to give the parties an opportunity to be heard by it and to present to it any evidence relevant to the appeal. The Complainant neither attended nor was represented at the hearing. Furthermore no evidence that the Respondent dismissed the Complainant within the meaning of the Unfair Dismissals Act 1977 was put before the Court.

In the circumstances the Court decides that the complaint is not well founded, dismisses the appeal and affirms the decision of the Adjudication Officer.

In accordance with section 44(1) (a)(ii) the Court decides that the complaint is not well founded, dismisses the appeal and affirms the decision of the adjudication officer.
