Notice of the making of this Statutory Instrument was published in

I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by section 40HA(1) (inserted by section 24 of the Health Service Executive (Governance) Act 2019 (No. 17 of 2019)) of the Health Act 2004 (No. 42 of 2004), hereby order as follows:

1. This Order may be cited as the Health Act 2004 (Section 40H) (Relevant Day) Order 2019.

2. The 9th day of August 2019 is appointed as the day to be the relevant day for the purposes of section 40H (inserted by section 23 of the Health Service Executive (Governance) Act 2019 (No. 17 of 2019)) of the Health Act 2004 (No. 42 of 2004).

EXPLANATORY NOTE

This Order appoints 9 August 2019 as the relevant day for the purposes of section 40H of the Health Act 2004 , as amended by the Health Service Executive (Governance) Act 2019 . Section 40H as amended requires the Board of the Health Service Executive (HSE) to appoint a new audit committee. The HSE’s old audit committee stands dissolved on the relevant day.
