HEALTH INSURANCE ACT, 1994 (MINIMUM BENEFIT) (AMENDMENT) REGULATIONS, 2005

I, Mary Harney, Minister for Health and Children, in exercise of the powers conferred on me by sections 3 and 10 of the Health Insurance Act, 1994 (No. 16 of 1994) as amended by section 13 of the Health Insurance (Amendment) Act, 2001 ( No. 17 of 2001 ), hereby make the following Regulations-

1. These Regulations may be cited as the Health Insurance Act, 1994 (Minimum Benefit (Amendment) Regulations, 2005.

2. The Health Insurance Act, 1994 (Minimum Benefit) Regulations, 1996 ( S.I. No. 83 of 1996 are hereby amended -

(a) in Article 3, by the substitution:-

(i) for “ancillary” of “relevant” in the definition of “fully insured person”,

(ii) for “Health Insurance Act, 1994 (Open Enrolment) Regulations, 1996 ( S.I. No. 81 of 1996 )” of “Health Insurance Act, 2001 (Open Enrolment Regulations, 2005” in the definition of “initial waiting period”,

(iii) for “Health Insurance Act, 1994 (Open Enrolment) Regulations, 1996 ( S.I. No. 81 of 1996 )” of “Health Insurance Act, 2001 (Open Enrolment Regulations, 2005” in the definition of “pre-existing condition waiting period”,

(b) in Article 5(1), by the substitution for “ancillary” of “relevant”,

(c) in Article 12, by the substitution for “ancillary” of “relevant”.

3. These Regulations shall come into operation on the 1st day of July, 2005.
