HSE v White

Facts: An application had been brought by the third named notice party seeking the disclosure of certain documents from the applicant who was a non-party to certain criminal proceedings taken. The second and third named notice parties were the family and daughter of a deceased woman who was alleged to have died from neglect and malnourishment. An independent review was commission by the applicant as to the circumstances of the death of the woman. The second and third named notice parties were then charged with the unlawful killing of the woman and then sought disclosure of various documentary materials relating to the investigation. An order was made in the Circuit Court directing the Health Services Executive to make available to the Director of Public Prosecutions inter alia all material made available to the investigation. The applicant had obtained leave for judicial review and various orders in respect of orders granted by the respondent. The applicant submitted that they were not a party to the criminal proceedings and that the duty of disclosure did not extend beyond the prosecution to non-parties. The issue arose as to the inherent jurisdiction of the courts and the applicable precedent to the proceedings.

Held by Edwards J. That the circumstances did not exist for the trial judge to fashion a novel remedy in the absence of a sound jurisdictional basis. The respondent had exceeded his jurisdiction and a Declaration would be granted, in addition to an order of certiorari.
