Horgan v WMG GRoup Ltd

Claimant worked as a driver for respondent. Initially his area was Munster but after an almalgation he drove all over Ireland. On one day he was called to the manager's office and told he was to do overseas jobs. The claimant declined as he would get sea-sick, it involved weekend work and the hours being asked to work were in contravention of the transport law and rules. On return from one job he saw he had been rostered to go to England on a trip. He told the manager he wouldn't go and he was suspended at first without pay then with pay..When he went to collect his pay he got the wrong amount, it was Christmas and he needed the money, he made several unsuccessful attempts to contact his union representative. He then put a picket on the premises and received worker support. He was given a letter of dismissal by the company....
