LEGALLY BINDING DECISION OF THE FINANCIAL SERVICES AND PENSIONS OMBUDSMAN

This complaint concerns a “Sickness Hospitalisation Income Policy” (the “Policy”) taken out

on 6 February 2008.

The Complainant’s Case

The Complainant has held a “Sickness Hospitalisation Income Policy” since 6 February

2008.

The Complainant completed an “IRE Sickness claim form” on 22 September 2021 and

submitted this to the Provider. This confirms that she had a diagnosis of breast cancer and

had a hospital admission to undergo surgery on 14 September 2021. She was discharged

on the same date. The claim form also confirms that she was unable to carry out her usual

work activities/ or usual activities (if not in paid employment) from 29 July 2021 to the

date of signing the Claim Form (22 September 2021).

The Complainant says she is unhappy that her claim under her Policy was declined because

her hospital stay was not overnight. The Complainant submits that it was “day surgery”

instead due to Covid”.
