Notice of the making of this Statutory Instrument was published in

I, FRANCES FITZGERALD, Minister for Justice and Equality, in exercise of the powers conferred on me by section 3 and subsection (5) of section 51 of the International Protection Act 2015 (No. 66 of 2015), hereby make the following regulations:

1. (1) These Regulations may be cited as the International Protection Act 2015 (Deportation) Regulations 2016.

(2) These Regulations come into operation on 31 December 2016.

2. The form set out in the Schedule is hereby prescribed for the purposes of subsection (5) of section 51 of the International Protection Act 2015 .

SCHEDULE

DEPORTATION ORDER

WHEREAS it is provided by section 51 of the International Protection Act 2015 (No. 66 of 2015) that, subject to the provisions of section 50 (prohibition of refoulement) of the Act, the Minister for Justice and Equality shall by order require a non-national specified in the order to leave the State within such period as may be specified in the order and thereafter to remain out of the State;

WHEREAS ........................ [insert name of person] is a person referred to in subsection (1) of section 51 and in respect of whom a deportation order shall be made under subsection (2) of the said section 51;

AND WHEREAS the provisions of section 50 (prohibition of refoulement) of the International Protection Act 2015 are complied with in the case of .......................... [insert name of person],

NOW, I, ............................. , Minister for Justice and Equality, in exercise of the powers conferred on me by subsections (1) and (2) of section 51 of the International Protection Act 2015 , hereby require you the said ................................ [insert name of person] to leave the State within the period ending on the date specified in the notice given to you under subsection (3) of the said section 51 and thereafter to remain out of the State.
