I, Micheál Martin, T.D., Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 2 of the Investment Funds, Companies and Miscellaneous Provisions Act 2005 (No. 12 of 2005), hereby order as follows:

1. This Order may be cited as the Investment Funds, Companies and Miscellaneous Provisions Act 2005 (Commencement) Order 2005.

2. In this Order, “Act” means the Investment Funds, Companies and Miscellaneous Provisions Act 2005 (No. 12 of 2005).

3. The 30th day of June 2005 is appointed as the day on which the following provisions of the Act come into operation, namely -

(a) Parts 1, 2 and 3,

and

(b) sections 29, 30, 38, 46, 56, 63 to 68, 70, 73(1), 73(2)(a),(b) and (c) 73(4), 75 to 84 and 87.

4. The 1st day of July 2005 is appointed as the day on which the following provisions of the Act come into operation, namely sections 39 to 45, 47 to 55 and 74.

5. The 6th day of July 2005 is appointed as the day on which the following provisions of the Act come into operation, namely —

(a) section 31 (but only for the purpose of repealing the enactments specified in that section in so far as they relate to a regulated market (within the meaning of Directive 2003/71/EC of the European Parliament and of the Council of 4 November 2003) operated by a recognised stock exchange within the meaning Part V of the Companies Act 1990 (No. 33 of 1990)),

and

(b) sections 32 to 37.

6. The 1st day of September 2005 is appointed as the day on which the following provisions of the Act come into operation, namely, sections 73(2)(d) and 73(3).
