ROAD TRAFFIC AND ROADS ACT 2023
(COMMENCEMENT) ORDER 2025
This Commencement Order will bring provisions several provision s
into effect. Under section 4, the Minister will have the power to
prescribe a unique identifier with vehicle ownership through
regulations. Section 11(a) amends section 35 of the 1994 Act, on
supplying information that is false or misleading in relation to applying
for a disabled parking permit. Section 11 (c) amends section 41 of the
1994 Act to create new grounds for vehicle seizure by An Garda
Síochána, specifically where the driver does not have a licence.

ROAD TRAFFIC ACT 1994 (DETENTION OF VEHICLES)
(AMENDMENT) REGULATIONS 2025
The Minister has made regulations entitled as above. These regulations
are necessary for section 11(c)(i) of the Road Traffic and Roads Act
2023, they specify that in the case where a vehicle is seized for a driver
not having a licence and, or if the car does not have a test certificate
(according to the EU standard i.e. the NCT) – but it is later proved that
the driver does have a licence and, or the car does have a valid test cert,
the seizure fee is to be waived. These regulations amend the existing
detention of vehicles regulations (S.I. 460/2011) and are being made in
conjunction with the Road Traffic Roads Act 2023(Commencement)
Order 2025.
