EUROPEAN UNION (MARKETING AND USE OF
EXPLOSIVES PRECURSORS) REGULATIONS 2026
“These Regulatio ns, which are made in accordance with th e powers
conferred on the Minister by section 3 of the European Communities
Act 1972 (No. 2 7 of 1972) and for the purpose of giving full effect to
Regulation (EU) 2019/1148 of the European Parliament and of the
Council of 20 June 2019, providing for:
• designation of the Minister for Justice, Home Affairs an d
Migration as the national inspection authority for inspecting
and controlling the correct application of Articles 5 to 9 of the
Regulation, in accordance with Article 11;
• the appointment of an inspector of explosives by the national
inspection authority for the purpose of ensuring compliance
with Articles 5 to 9;
• the outlining of the powers of inspectors of explosives
precursors, which include the power for inspectors to enter and
inspect premises where regulated explosives precursors or
related records are suspected to be held, the power to inspect
and copy documents, and the power to obtain samples to check
for compliance with Articles 5 to 9; and
• providing for penalties applicable to infringements of
Regulation (EU) 2019/1148 in accordance with Article 13.

The Minister for Housing, Local Government and Heritage, in exercise
of the powers conferred on h im by section 3 of the European
Communities Act 1972 (No. 27 of 1972) and for the purpose of giving
effect to Article 11(3)(g) of Directive 200 0/60/EC of the European
Parliament and of the Council of 23 October 2000, has made the
Regulations entitled as above.
