EUROPEAN COMMUNITIES (BIRDS AND NATURAL

HABITATS)(AMENDMENT) REGULATIONS 2026

The purpose of these Regulations is to amend the European

Communities (Birds and Natural Habitats) Regulation 2011 –

(a) In the definition of project, in order to clarify that projects

which are subject to the Appropriate Assessment provisions

in Part XAB of the Planning and Development Act 2000

are not also required to be subjected to the Appropriate

Assessment process under these Regulations, and

(b) to transpose the requirements of Articles 16b(2) and 16f of

the Renewable Energy Directive into the law of the State.
