Abstract:

Unfair dismissal - Walk off site

An incident in work between the claimant and another worker involving a troller being pushed by the claimant resulted in an inconclusive enquiry by the company as to what happened. Two years later the claimant, having suffered from stress arising from the incident gave his employers' an option of resolving the issue or he was refusing to work. He failed to return to work after that. The respondent company wrote nine letters to the claimant asking him to return to work or attend a meeting to discuss the matter. As the claimant refused he was dismissed. The Tribunal determined that the claimant had acted unreasonable and the respondent had done everything to resolve the matter. Claim was...
