246 CHANCERY REPORTS. In the matter of KENNY S minors. MR. NORMAN moved a petition to make two minors wards of Court. Two testamentary guardians had been appointed by the minors' father. One of them was dead ; the other declined to act. The minors were entitled, under their father's will, to a sum of 3433. Is. Od. Mr. Kenny, the executor of his will, had consented to act ; and Counsel asked that he should be appointed guardian without the expense of a reference to the Master. His Honor said that, if a proper person was named, and the executor offered to bring in the money, he should appoint a guardian without a reference. On a subsequent day the following order was made:- Michael Kenny, executor of William Kenny deceased, the father of the minors, attending, and undertaking to transfer 3433. Is. Od., it is ordered by the Right Honorable the MASTER OF THE ROLLS, that the minors be, and they are hereby made wards of Court. And it is ordered that the said Michael Kenny (he so undertaking) do, within one month from the date hereof, transfer to the credit of this matter, with the privity of the Accountant-General of this Court, the said sum of 3433. Is. Od., stock, &c., less by the amount of 21 of said stock, which is hereby allowed to Mr. Abraham Coates, the petitioner's solicitor, for the costs of this petition, and order thereon, and proceedings thereÂÂunder. And it is further ordered that the said Michael Kenny be, and he is hereby appointed guardian of the persons and fortunes of the said minors ; and that he be, and is hereby allowed the annual sum of 90, for the maintenance, clothing, and education of the said minors, until further order. And it is further ordered that said CHANCERY REPORTS. 247 minors do continue at Zion Hill convent school, situate at Black-rock, in the county of Dublin, until further orÂÂder.
