M (T) v Minister for Justice

Facts The fifth named applicant, a Chinese citizen, is the mother of the first named applicant and the grandmother of the third and fourth named applicants. She is a widow and it is claimed that she is now dependent on her daughter and son-in-law. She travelled on a number of occasions to visit her family on short term stay visa's. She was refused an extension to remain in the state. The applicants successfully obtained leave in the High court to challenge the decision of the respondent to refuse to extend her permission to reside in the State, on the grounds, inter alia, that the respondent has adopted and had applied an inflexible policy position such that his decision did not represent a genuine and a judicial exercise of the discretion vested in him.
