Melissa Middleton v Dunnes Stores Limited

Claimant returned to work after two days sick leave and gave the assistant manager a doctor's certificate. He asked her to fill for another worker on the following day. The claimant declined due to short notice and a prior committment. A heated discussion followed resulting in the claimant being brought to the personnel manager's office. The assistant manager denied that a cert was offered and while in the office the assistant manager referred to numerous applications for her job and told her where the door was. The Tribunal determined that she was dismissed and that it was unfair. Awarded a total of £1,340
