The plaintiff was the owner of lands in the county of Dublinwithin the functional area of the Dublin County Council. The defendant housing authority made a compulsory purchase order affecting the lands of the plaintiff and other lands outside its area. Evidence adduced at a public inquiry established that the defendants wished to acquire the lands partly to satisfy the housing needs of the defendants and partly to satisfy such needs of the Dublin County Council. The defendant's order was confirmed by the Minister for Local Government. The plaintiff issued a special summons in the High Court seeking to have the compulsory purchase order quashed.
