Abstract:

Unfair dismissal - Constructive dismissal - Onus of proof

Claimant employed as transport manager since 1982 with respondent. In 1998 there was a change in the company's personnel and although he remained in the same position he felt the trust between him and the employer was gone and he felt he had no alternative but to leave his job. The Tribunal determined that the claimant had failed to discharge the onus of proof and dismissed the claim.
