"Gross rent" - Basis of fixation - Tenements of "similar character" - Regard to - Whether limited to physical and structural character - Character of user - Licensed vintner's establishment.
In fixing the "gross rent" of premises used as a licensed vintner's establishment the Circuit Judge had regard to (inter alia) the value of the licence. Held, on appeal, that the expression in s. 29 (f) of the Landlord and Tenant Act, 1931, ". . . . having regard . . . to the letting values of tenements of a similar character . . . ." was confined to physical and structural similarity, and, accordingly, that the value of the licence should not have been taken into account.
