National Asset Management Agency v Commissioner for Environmental Information
Facts: On the 3 rd February 2010, a request was made of the National Asset Management Agency (henceforth ‘NAMA’) for information pursuant to Article 6 of European Communities (Access to Information on the Environment) Regulations 2007 (the "2007 Regulations"). This request was refused but a subsequent appeal to the respondent was upheld on the 13 th September 2011 on the basis that NAMA was obliged to comply as it was a public authority in accordance with Article 3(1)(vi) of the 2007 Regulations. NAMA denied this assessment and appealed to the High Court pursuant to Article 13(1) of the 2007 Regulations, seeking a court order for the matter to be either remitted to the respondent for a reassessment or a court order giving a substituted decision.
It was NAMA”s submission that Article 3(1)(vi) of the 2007 Regulations, which gives a definition of a public authority under three sub-paragraphs before listing seven potential public authorities which are preceded by the words ‘and includes’, was not applicable to its agency. NAMA argued that when the words ‘and includes’ were given their dictionary meaning, it limited the scope of the provisions so that in order to qualify as a public authority, a body had to come within the meaning of the first three sub-paragraphs of the list outlined in the article as a prerequisite. Since NAMA was not specifically mentioned in these sub-paragraphs, it argued it was clear that it could not be considered a public authority.
