Facts: The proceedings for judicial review arose out of a Variation to the Waste Management Plan for the Dublin Region 2005-2010 made by the respondents in 2008. The Variation had the effect of excluding private operators from the domestic waste collection market. The applicant contested the Variation on the grounds that it amounted to an abuse of a dominant position and amounted to an agreement between undertakings which had as its object to restrict competition. The applicant also contended that the Variation was ultra vires the respondents as it was inter alia vitiated by errors of law in that it sought to remove competition from the domestic waste collection market and stop private operators from collecting waste. The applicant alleged that the Variation was contrary to s. 4 Competition Act 2002 and that it amounted to an abuse of a dominant position.

Held by McKechnie J. the respondents were undertakings for the purposes of the Act of 2002 and ss. 4 & 5 were applicable to the actions of the respondents. The Variation was an agreement between the undertakings or a concerted practice. There was no objective justification to save the Variation and the respondents thus breached s. 4 of the Act of 2002. The respondents were dominant in their respective areas. They abused that position of dominance. The Variation was not saved and would not have an appreciable effect on inter State trade. The Variation was ultra vires as it clearly went beyond that contemplated by the Oireachtas. The Court could not see how the Variation could be said to be a disproportionate interference with the property rights or right to earn a livelihood of the applicant. If in fact they were prevented from collecting household waste it would not leave them without a source of income. The Court would accede generally to the case of the applicant and would order that the Variation be quashed.
