Abstract:

Dismissal - Constructive

The claimant worked as a house assistant which included the responsibility of cleaning stains from carpets. She developed asthma and had to avoid certain substances but did not inform her employer. On an occasion she was questioned for not removing a stain from a carpet, she referred to her ashma. The employer requested a doctor's certificate which was produced but did not give the employer enough information. The employer suspended the claimant on pay pending the fuller details being made known to them. The claimant sought her P. 45 and was paid up to the date it was issued. The tribunal determined that the employer treated the problem with sympathy and understanding. The was no action of the employer which would have provoked her resignation...
