Abstract:

Dismissall - Fall off in business - Merger with another company - redundancy - Whether claimant was made redundant or dismissed

The respondent company encountered trading difficulties and merged its business with a hydraulics business resulting in an overlap of certain people and therefore causing redundancies. The claimant alleged that there was plenty of work and encountered a change of attitute towards him after he returned after sustaining an injury at work. He also complained about a cheque he couldn't cash and new clocking in times. The Tribunal determined that the claimant was dismissed by way of redundancy and dismissed his claim.
