In the Central Criminal Court the respondent was charged with certain offences. On the direction of the trial judge, the jury found him not guilty on all counts prepared against him. The appellants appealed to the Supreme Court against his acquittal. The circumstances relating to the respondent's indictment were as follows. In August, 1979, three men were arrested by Gardaí and charged with offences contrary to the Misuse of Drugs Act, 1977. The respondent was not one of them Some days later the respondent instructed his solicitor that he wished to make a statement to certain named members of the Garda Síochána. He then volunteered a lengthy statement to the Gardaí in which he alleged that he had been innocently involved in an incident with drugs which had occurred some days before.
