Personal Injuries Assessment Board Act 2003 (Commencement) (No. 2) Order, 2004

I, MARY HARNEY, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 2 of the Personal Injuries Assessment Board Act 2003 (No. 46 of 2003), hereby order as follows:

1. This Order may be cited as the Personal Injuries Assessment Board Act 2003 (Commencement) (No. 2) Order 2004.

2. In this Order “the Act” means the Personal Injuries Assessment Board Act 2003 (No. 46 of 2003).

3. Subject to Article 4 of this Order, the 1st day of June 2004 is appointed as the day on which the Act, in so far as not already in operation, comes into operation.

4. Article 3 of this Order does not apply to paragraph (b), (c) or (d) of section 3 of the Act.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order appoints the 1st day of June 2004 as the date on which the Personal Injuries Assessment Board Act 2003 (No. 46 of 2003), in so far as it is not already in operation, comes into operation, with the exception of sections 3(b), 3(c) and 3(d) of the Act. This means that from the 1st of June 2004 all personal injury claims arising from workplace accidents (where employee is seeking compensation from his/her employer) must be referred to the Personal Injuries Assessment Board before legal proceedings are issued.
