Notice of the making of this Statutory Instrument was published in

I, EOGHAN MURPHY, Minister for Housing, Planning and Local Government, in exercise of the powers conferred on me by subsection (3) of section 1 of the Planning and Development (Amendment) Act 2018 (No. 16 of 2018), hereby order as follows:

1. This Order may be cited as the Planning and Development (Amendment) Act 2018 (Commencement) Order 2018.

2. The 22nd day of October 2018 is appointed to be the day on which the following provisions of the Planning and Development (Amendment) Act 2018 (No. 16 of 2018) shall come into operation:

(a) Part 1 in so far as it is not already in operation;

(b) Part 3 (other than paragraph (c) of section 21, subsection (4) of section 23, paragraph (c) of subsection (5) of section 23, and sections 5, 8, 33, 34, 40, 42, 45 and 49) in so far as it is not already in operation;

(c) Part 5; and

(d) Schedules 2, 3 and 4.

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation).

In this Order the Minister appoints 22 October 2018 as the date on which specified provisions of the Planning and Development (Amendment) Act 2018 come into effect, including the statutory underpinning for the recently adopted National Planning Framework and the intended Marine Spatial Plan as well as a number of other provisions emanating from the Tribunal of Inquiry Into Certain Planning Matters and Payments planning recommendations and specific actions required to be implemented under recent Government policy decisions.

The Order commences Part 1 and Part 3 (other than other than other than subsection (4) of section 23, paragraph (c) of subsection (5) of section 23 and sections 5, 8, 33, 34, 40, 42, 45 and 49) in so far as not already in operation, Part 5 and Schedules 2, 3 and 4 of the Act.

Sections 2, 50, 51, 52, 53, 54, 55, 57 and Part 4 of the Act commenced upon enactment.
