I, LEO VARADKAR, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 20 (inserted by section 47 (1) of the Maritime Safety Act 2005 (No. 11 of 2005)) of the Merchant Shipping Act 1992 (No. 2 of 1992) and the Maritime Transport, Safety and Security (Transfer of Departmental Administration and Ministerial Functions) Order 2005 ( S.I. No. 842 of 2005 ) (as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 )), hereby make the following regulations:

1. These Regulations may be cited as the Pleasure Craft (Personal Flotation Devices and Operation) (Safety) (Amendment) Regulations 2012.

2. The Pleasure Craft (Personal Flotation Devices and Operation) (Safety) Regulations 2005 ( S.I. No. 921 of 2005 ) are amended, in Regulation 2, by inserting after the definition of “open craft” the following:

“ ‘personal watercraft’ means a craft of less than 4 metres in length which uses an internal combustion engine having a water jet pump as its primary source of propulsion, and which is designed to be operated by a person or persons sitting, standing or kneeling on, rather than within the confines of, a hull;”.

The purpose of these Regulations is to amend the Pleasure Craft (Personal Flotation Devices and Operation) (Safety) Regulations 2005 ( S.I. No. 921 of 2005 ) by inserting a definition of “personal watercraft” into the 2005 regulations.
