Abstract:

Dismissal - Accident at work - Sick leave - Medical certificates - Working while on sick leave for third party

The claimant sustained an injury while working for the respondent and obtained sick leave. He submitted medical certificates initially. While onsick leave the respondent claimed that the claimant had been spotted working elsewhere.He was dismissed for this reason. The claimant disputed these claims. The Tribunal found that the claimant did work for a third party while on sick leave from the respondent. They referred to a private investigator's photograph's showing the claimant engaged in manual labour. The Tribunal dismissed the claim.
