Judgment had been recovered in an action against a defendant who, at the date of the issue of the writ, was registered as the owner of an undivided share of certain lands. Subsequently he made an application to the Land Registry, in pursuance of which his name was removed from the register and thelands entered in the names of his brother and uncle as tenants-in-common.
