No evidence of trade being conducted in public - house - Applicant for renewal of licence requiring certificate of District Justice as to "peaceable and orderly manner in which such house had been conducted in the past year" - Whether any jurisdiction to issue certificate - Spirits (Ir. ) Act, 1854 (17 18 Vict. c.89), s. 11 - Intoxicating Liquor Act, 1960 (No.18), s. 30.
In the absence of evidence that a licensed trade has been conducted in a public-house in the past year, a District Justice has no jurisdiction (apart from the provisions of s. 30 of the Intoxicating Liquor Act, 1960) to issue a certificate as to "the peaceable and orderly manner in which such house had been conducted in the past year" in accordance with the terms of s. 11 of the Spirits (Ireland) Act, 1854.
