Controlled dwelling - Application by landlord for determination of basic rent - Application made by personal representative of deceased landlord - Rent Restrictions Act, 1960 (No. 42), s. 8, sub-s. 1A.

The applicants applied, as landlords, for a determination by the District Court of the basic rent of a controlled dwelling under s. 8. sub-s. 1A, of the Rent Restrictions Act, 1960. In order to succeed, the applicants had to establish, pursuant to para. (e) of the sub-section, that the premises were a controlled dwelling in respect of which "the landlord at the time of the application . . . was the landlord on the 8th day of June, 1966, and has been the landlord continuously from that day." The facts were that the applicants were theexecutors appointed by the will of a testatrix who had been the landlord, of the premises and who had died on the 23rd February, 1967. The...
